Terms of Use

1. License

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the apps on devices you control. You may not modify, translate or create derivative works; reverse-engineer, decompile or disassemble; copy, distribute, sell, rent or sublicense; use the app or its documentation to develop a competing product; remove copyright notices; or circumvent protection measures.

2. Your content

The files, voices and presets you open, create or export are yours — the app acquires no rights over them. You are responsible for having the right to use anything you import.

That applies to what is truly yours: your own creations and files you are licensed to use. The apps’ factory content follows section 4.

3. Third-party rights and piracy

The apps work with the files you put into them yourself. RSJB does not supply, host or check that content: SoundFonts, instruments, samples, banks, voice cartridges and instrument files belong to whoever made them, and their licenses apply.

You may not use the apps with pirated content or content obtained without a license (for example commercial sound libraries, manufacturers’ factory banks or cartridges downloaded without permission), and you may not use them to break encryption, licensing, activation or any other protection of a library, instrument or program.

Converting, merging, splitting, editing or exporting grants no license: the result stays subject to the license of the material it came from. Share, publish or sell the result only if that license allows it.

If a rights holder points to a violation, we may remove the content or the feature involved and end access to online services, such as Tonica, for anyone who breaks these rules. See section 7.

4. Our apps, our marks and the factory content

The names of the RSJB apps, the RSJB name, the logos, icons and visual identity are ours. Do not use, copy or imitate them — in an app name, company name, domain, profile, ad or product — without written permission.

RSJB’s content — code, sound engine, sounds, factory presets and banks, images, texts, documentation and the sound-authoring kits published on our websites — is protected by copyright, whether it is ours or licensed to us. You may use the factory sounds in your music, including to record and release it. You may not extract this content and distribute, sell or publish it as sounds, banks, presets, images or texts — or use it to build a competing product.

The authoring kits published on our websites may be copied and used to create sounds for RSJB apps; they may not be sold or republished as someone else’s product.

We license only apps obtained from the official stores (App Store and Google Play) or by our invitation (such as TestFlight). Copies, modified files, “cracks”, shared licenses or accounts, and resale are piracy: they carry no license and no support, and we may ask the stores to remove them and take the measures the law allows.

5. Third-party trademarks

RSJB apps are independent products: no manufacturer, company, store or platform mentioned makes, endorses or sponsors them, or has any affiliation with them.

All names, models and trademarks mentioned belong to their respective owners. They appear only to say what each app works with or which files it opens (descriptive use); mentioning a name does not mean partnership or approval. The list of attributions is in the footer of every page.

6. Tonica (sounds published by users)

On Tonica you may publish sounds you made yourself. By publishing, you state that you are the author or have permission to do so, and you give us a free, non-exclusive license to host, display and let other people download and use that sound inside the apps. The sound remains yours.

Do not publish: other people’s creations without permission; copies of sounds from other products; names or texts with trademarks, instrument models, artists or songs; links, e-mails or profiles; or offensive content. Some apps already reject names with trademarks and models automatically; that does not relieve you of following this rule.

Anyone can report a sound from inside the app (reasons: offensive, trademark, spam or broken). We may remove sounds and block anyone who keeps breaking these rules, without notice.

7. Reporting a rights violation

If you hold rights — or represent someone who does — and believe something in the apps, on the website or on Tonica violates your copyright or trademark, write to app@rsjb.com.br with the subject “Rights violation” and tell us: who you are and how to reach you; which work or mark is involved; where the content is (app, screen, sound number or page address); and that the information is true and that you may act on behalf of the owner.

We reply within 2 business days and, once the violation is confirmed, remove or fix the content without delay. If your content was removed and you think it was a mistake, reply to the same e-mail explaining: we review in good faith.

8. No warranty

The apps are provided "as is", without warranties of any kind. We do not warrant that they are error-free or that generated files are compatible with every piece of hardware or software. Back up your files before processing them.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for loss of files or data, lost profits, or any indirect, incidental or consequential damages arising from the use or inability to use the apps.

10. Instrument editor apps

The editor apps (currently KR Editor, NL4 Editor and NX Editor) talk to your instrument over USB/MIDI: they read data from it, send commands and data, and can write to its memory (sounds, banks, Set Lists, settings). While you edit live, the sound being edited on the instrument is also replaced. Before you use them:

• ·make a complete backup of the instrument with the manufacturer’s own tools — writing over a slot replaces what was there, and the copy some apps keep does not replace your own backup;
• ·check which slots and banks will be written before you confirm;
• ·do not power off, unplug or let the instrument sleep during a write or transfer;
• ·update the instrument’s firmware or system only with the manufacturer’s official tools — our editors do not do that.

11. Liability for the editors

You use the editors at your own risk. To the fullest extent permitted by law, we are not liable for loss or corruption of data, sounds, banks or Set Lists; for malfunction of the instrument; for damage to the equipment, including rendering it inoperable (“bricking”); for loss of the manufacturer’s warranty; or for lost profits or indirect damages — arising from the use of, or inability to use, the app, errors in the app, communication with the instrument, or your own or third parties’ actions. The editors are independent: instrument manufacturers do not make them, endorse them or provide support for them. Nothing in these Terms affects the rights the law gives you as a consumer.

12. Updates and discontinuation

We may update the apps, add or remove features, or discontinue them at any time. You are not entitled to compensation for removed features or discontinuation.

13. Governing law

These Terms are governed by the laws of Brazil. Any disputes will be resolved in the courts of São Paulo, SP.
